Can I ask for a pay rise whilst on maternity leave?

I have been at my current company for nearly two years and I have had one payrise at my request. I would like to ask for a pay rise to bring my salary in line with the rising inflation. I am good at my job and have had excellent reports in all my appraisals. Salary reviews & appraisals take place in April whilst I am on maternity leave. I feel I shouldn’t be penalised just for having a baby.

You should receive a payrise anyway whilst you are maternity leave, if your annual pay review takes place whilst you are absent you should receive an increase either based on the average of other people’s rises or on your performance prior to your leave starting.

This is a complicated area because there is no a piece of case law which states that any increase you receive whilst getting maternity pay should be incorporated into your pay (see Alabaster v Woolwich).

If you do not receive an increase then you may well have grounds to claim sex discrimination as the reason you have not had the increase is that you were on maternity leave and you were on maternity leave because you had a baby and you had a baby because you are a woman hence – discriminated against because of sex.
